Toddler Fatally Shot, Father Wounded Outside Home

LOS ANGELES, CA (AP) -- A three-year-old girl was killed and her father was seriously injured yesterday when two men drove up to their Baldwin Hills apartment and started shooting as the family got out of their car.

Police say 24-year-old Cesar Avila was helping his two daughters get out of the family's car when the two men pulled up in front of their apartment in a minivan.

One got out of the vehicle, walked up to the family and started shooting.

Avila suffered several gunshot wounds to his torso and was taken to UCLA Medical Center. His daughter, Kaitlyn, was pronounced dead at Cedars-Sinai Medical Center.

Authorities say they believe the shooting was gang related, though there's no evidence Avila was a gang member.

Police say the assailants identified themselves as gang-members before the shooting, and that the motive may have been territorial.

NEWS REPORTS SAY THEY WERE FROM BPS AND ASSUMED THAT THE MAN THEY SHOT AT. HAD GANG TIES SHIT WENT DOWN AROUND 2:40 P.M. The family of a 3-year-old girl killed Sunday in Baldwin Hills asked for the public's help Wednesday in finding the gunman, while City Councilman Herb Wesson promised a $50,000 reward in the case.

The gunman, described as a 20-something black man with his hair in two long braids, opened fire on Cesar Avila as he was helping his daughters out of a vehicle in front of his home at about 2:45 p.m. Sunday, authorities said.

Kaitlyn Avila was fatally wounded, while her 24-year-old father remains hospitalized in critical condition, unaware that his daughter is dead.

Kaitlyn's 5-year-old sister, Cassey, who witnessed the shooting but was uninjured, does not quite grasp what happened yet, Francisco Hernandez, the girls' uncle, said.

"Now she says: `Don't play with my sister's toys because she's going to come back,"' he said.

Deputy Chief Charlie Beck, commanding officer of the LAPD's South Bureau, said the two assailants identified themselves as gang members before opening fire. They apparently believed the girl's father belonged to a rival gang, Beck said, though police have no evidence that.

The vehicle the suspects fled in was believed to be a gray Nissan Quest minivan or a gray Chrysler 300 C, police said. The gunman, who was wearing a white T-shirt, was about 6 feet tall or shorter, witnesses told police.

Los Angeles City Councilman, who represents the area where the shooting occurred, will ask his colleagues at Wednesday's council meeting to approve a $50,000 reward for information leading to the killer.

Anyone with more information about the suspects was asked to call police at (877) 529-3855.

Arrest Made In Shooting Death Of 3-Year-Old Girl

(CBS) LOS ANGELES An arrest was made in connection with the shooting death of 3-year-old Kaitlyn Avila in Baldwin Hills on Sept. 24, according to Los Angeles police.

The arrested suspect's identity as well as the photo of a second suspect will be released in a news conference late Monday morning.

The shooting occurred about 2:45 p.m. Sept. 24 in the 4500 block of Pinafore Street, according to authorities.

Cesar Avila was helping his daughters out of a vehicle in front of his home when shots rang out. He was critically wounded; Kaitlyn was fatally wounded. Her 6-year-old sister, Kassey, who witnessed the shooting, was not hurt.

The gunman and the getaway driver shouted a gang slogan before the attack. Police said Cesar Avila was not a gang member but was apparently targeted after taking his daughters to a McDonald's.

LOS ANGELES -- A group of community leaders is urging the 17-year-old suspected gang member accused of gunning down a 3-year-old girl in Baldwin Village two weeks ago to turn himself in.

Police on Monday identified the suspect as Jonathan Durrell Banks and said he shot Kaitlyn Avila in the chest at point bank range, killing her intentionally -- a callous execution that went beyond even what gang members consider usual.

Banks, who is 6 feet tall and weighs about 200 pounds, is believed to be hiding somewhere in Los Angeles, said police Deputy Chief Charles Beck. A $50,000 reward was offered for information leading to his arrest.

The shooting occurred about 2:45 p.m. on Sept. 24. Cesar Avila and his daughters Kaitlyn, 3, and Kassey, 6, had just arrived at their home in the 4500 block of Pinafore Street after lunching at a McDonald's when a gunman walked up, shouted a gang slogan and opened fire, authorities said.

Kaitlyn was killed and her father, a glass worker who appears to have been mistaken by the shooter for a gang rival, was critically wounded, according to police. Kassey witnessed the shooting, but was not hurt.

Police said the gunman and his accomplice sped away in a gray Chevrolet Pacifica.

The suspected getaway driver, Laron Lee Larrimore, 26, was arrested Friday afternoon at a motel in the 3500 block of Slauson Avenue by a joint LAPD-FBI task force, police said.

"The shooting of Kaitlyn increased tensions between black and Latino residents in South L.A.," said Earl Ofari Hutchinson, president of the Los Angeles Urban Policy Roundtable which is organizing a news conference at the crime site at noon on Tuesday, where a coalition of community leaders will call for Banks to surrender.

"The arrest of the second suspect will calm tensions, alleviate the fears of residents over their safety and help promote community peace," Hutchinson said.

The president of the Los Angeles Civil Rights Association called Kaitlyn's shooting "a terrible tragedy for our community."

"A speedy arrest will send the message that violence will not be tolerated," Eddie Jones said.

The motive for the attack remains under investigation. Both suspects are known gang-members and may have mistaken Avila for a rival, according to Beck.

It was unclear whether the attack was racially motivated, but police held community meetings with Latino and black residents in South Los Angeles to keep tensions from rising.

"Obviously there's a racial difference between the suspects and the victims in this case, but we believe it is the monster of gang activity in South Los Angeles that is that cause of this shooting," Beck said.

A memorial with a crucifix, balloons, candles and photo of toddler has been set up outside the Avila home.

Police arrest suspected gang member in LA toddler's slaying

LOS ANGELES - A 17-year-old suspected gang member accused of gunning down a 3-year-old girl in her driveway was captured Tuesday after authorities received a tip on his whereabouts. The arrest came hours after the little girl was buried.

Jonathan Banks was taken into custody without incident about 2 p.m. in San Bernardino County by authorities who had been conducting surveillance after receiving a tip Monday night through a telephone hot line, police said.

Further details about the call were not released.

Kaitlyn Avila was shot Sept. 24 when two men pulled up in front of her family's Baldwin Village apartment as she, her father and her 6-year-old sister were getting out of their car following a trip to McDonald's.

The triggerman wounded her father, Cesar Avila, mistakenly believing he was a member of a rival gang, then shot Kaitlyn once in the chest at point blank range in what police called "a callous killing." She died Oct. 1.

At a news conference announcing the arrest, her parents thanked authorities.

"At least we know they're not out there harming other people," said Cesar Avila, as he held his wife's hand. Both wore white T-shirts with a picture of their daughter and the words, "My Princess Will Always Be in My Heart."

"We feel a lot better," her father said.

"Thank God they are going to pay for what they did," added her mother, Luz Hernandez.

Los Angeles Deputy Chief Charles Beck said police hoped Banks, arrested for investigation of murder, would be tried as an adult. Police were still working to forward their case to prosecutors.

"This is a murder that affects us all," Beck said. "The senseless intentional murder of a 3-year-old is horrendous."

A joint task force of the LAPD and FBI had arrested the alleged driver last week.

Beck said the shooting underscored continued gang problems in the Southwest Los Angeles neighborhood of Baldwin Village. Two warring gangs occupy the area: the Black P-Stones, a mostly black gang, and 18th Street, a mostly Latino gang.

Though the victims were Hispanic and the suspects black, police officials said they believe the shooting was gang-related, not racial.

Alleged Getaway Driver Pleads Not Guilty in 3-year-old Girl's Slaying

Los Angeles (CNS) -- The alleged getaway driver in the shooting of a 3-year-old girl killed in a gang-related attack in Baldwin Village pleaded not guilty today to murder and attempted murder charges.

Los Angeles Superior Court Commissioner James N. Bianco ordered Laron Lee Larrimore, 26, to remain jailed on $2 million bail.

He is due back in court tomorrow for further proceedings.

Larrimore, who was arrested Friday, is charged with one count of murder for the September 24th killing of Kaitlyn Avila, along with two counts of attempted murder.

The child’s father, Cesar Avila, was wounded and spent nine days in a hospital, part of it in a coma. His 6-year-old daughter escaped injury.

The accused triggerman, 17-year-old Jonathan Durrell Banks, is expected to be arraigned tomorrow, said Jane Robison of the District Attorney’s Office.

Information provided by a tipster led to Banks’ arrest in San Bernardino County yesterday, shortly after community activists pleased for him to surrender.

Banks is accused of opening fire on Avila and his two daughters as they were getting out of a car in front of their home in the 4500 bloc of Pinafore Street after a trip to McDonald’s.

Police allege Banks intentionally shot the girl in a neighborhood that is home to warring black and Latino gangs.

Durrell and Larrimore allegedly shouted a gang slogan before the gunfire rang out.

We see/hear this tragedy on the news and in print. It's an unfortunate situation to be in, but it is what is going down in the streets.

But without getting carried away with emotion (though it's hard cause I got kids myself), what is the tally of 18st smokin' innocent non-gang affiliated blacks in that neighborhood? Is that being fairly reported as well?

Bratton wanna jump in front of the news when it's an easy open/shut case. Was Mayor Villiraigosa on this too? Earl Hutchinson has voiced his opinions. Where is everyone else at?

I feel regardless of the race or gang, if you openly blast on kids and innocent civilians, you are not a soldier, but a coward and a punk.

I also feel that so called "shot callers" should check their own, or suffer the same fate. The fact is many fools want to be hard, but to the wrong people.

I feel for this man's family and other's like his. Remember the 3 year old shot and killed by the Avenues some years ago. Hard working people are tired of this ignorant insane behavior. People just want to work and provide a safe enviroment and shelter for their families.

That 17 year old fool is finished. The city is going to make an example on him. He'll be watching his back in Corcoran for the rest of his life, as far as the BPS and Jungles "18th Streeters", the heat is on.
