Gang member convicted in 2001 murder

POMONA (KABC) -- A 35-year-old man was convicted Wednesday of capital murder for the August 2001 slaying of a Cal Poly Pomona student who disappeared on her way to a fraternity party and was found the next day with her throat slit.
The fate of James Winslow Dixon Jr. came down to the decision of jurors in Pomona Wednesday. The 35-year-old man was convicted Wednesday of capital murder for the August 2001 slaying of Cal Poly Pomona student Christina Burmeister. "They found Mr. Dixon guilty of the murder. He was also charged with two rapes from twelve years ago. He was found guilty of both of those rapes, involving one incident. There were special allegations that were all found to be true," said Nancy Sperber, a defense attorney.
DNA taken from a cigar butt found in or near her truck tied James Dixon to the crime, sheriff's Detective Philip Guzman said in 2005. The special circumstances made Dixon eligible for the death penalty. During the trial Dixon alleged his wife and another man kidnapped Burmeister near a Pomona fraternity house on August 17, 2001.
Prosecutors say they then took her to a Montclair ATM and had her withdraw money from her account. They then drove her up Highway 39 into the mountains where Dixon slit her throat.
Dixon's wife and the other co-defendant have already pled guilty.
Defense Attorney Nancy Sperber says Dixon was not surprised by the verdict Wednesday. "I think he expected what was going to happen based on the evidence and what happened with his wife and the other co-defendant."
Sperber is now preparing for the penalty phase.
"Obviously we are going to argue that Mr. Dixon should not get the death penalty. Strategy wise what our argument is based on I am not at liberty to discuss it at this time. You will always argue to save someone's life," said Sperber.
Jurors are due back in court Monday for the start of the trial's penalty phase, in which they will be asked to recommend whether Dixon should be sentenced to death or life in prison without the possibility of parole.

LOS ANGELES — A South Los Angeles gang member who wrote a critically praised autobiography behind bars has been sentenced to six years in state prison for a 2006 carjacking.
Kody "Monster" Scott, 44, was sentenced Monday after pleading no contest to carjacking. Four other counts against him were dismissed as part of a plea agreement, Los Angeles County district attorney's spokeswoman Sandi Gibbons said Tuesday.
Scott, arrested last year, was accused of taking a silver Jaguar that belonged to a friend whom he beat so badly the man needed facial surgery.
A call to Scott's attorney seeking comment was not immediately returned.
Scott, who also goes by the name Sanyika Sakura, was in prison when he wrote "Monster: The Autobiography of an L.A. Gang Member." He wrote that he killed, robbed and committed other crimes since being inducted into a street gang at age 11. The 1993 book is the basis for a planned movie.
Scott previously served four years in state prison for armed robbery and possession of an AK-47 assault rifle, and had shorter terms for other crimes.
Police contend that he retains gang ties despite a professed conversion to Islam and a renunciation of violence. He was on a list of the 10 most-wanted gang members issued by the Los Angeles Police Department last year.

A gang member has been sentenced to 297 years to life in prison for his role in two drive-by shootings that occurred in Woodland in 2004.
A jury convicted Arnoldo Juarez, 29, in April of 11 counts of attempted murder and two counts of shooting at occupied dwellings, according to a news release.
Prosecutors alleged that the shootings were done in retaliation for an injury Juarez sustained in 2001.
Juarez is a member of a Salinas-based gang, authorities said.

Hector Navarro, 21, of Bakersfield, pleaded no contest May 9 to assault with a semi-automatic firearm for the benefit of the Sureño street gang and Mario Barrita, 23, of Modesto, pleaded no contest to possession of an assault weapon for the benefit of the gang, according to a department press release.
Prosecutors maintained that Barrita, Navarro and two passengers drove to south Modesto Sept. 16, 2006, to look for rival Norteño gang members.
On the 1700 block of Spokane Street, Barrita gave Navarro a Tech 9 assault weapon, and Navarro rolled down the passenger window and confronted two men attending gathering outside their grandfather's home. Neither man was a gang member, according to the Stanislaus County Sheriff's Department.
Navarro began yelling at the two men and shot at them one time but no one was hit, according to prosecutors. Navarro and Barrita then sped away but the sport utility vehicle they were in was stopped soon on Whitmore Avenue and they were arrested, according to prosecutors.
Navarro also pleaded no contest to battery on a deputy while in custody on the other charges and was sentenced to a total of 12 years in state prison. Barrita, whose plea also covered an unrelated domestic violence charge, was sentenced to a combined six years, according to prosecutors.

On May 20, Judge James Hollman sentenced five Oriental Troop gang members to life sentences after a jury found them guilty of first degree murder and conspiracy to commit murder, along with gun and gang special allegations.
On Oct. 1, 2006, just before sunset, five Oriental Troop gang members, including Chawa See, Lavang See and Aitang See, all of whom had their faces covered with bandannas or doo-rags, walked up two blocks on NE 4th Street in Visalia, to find and kill rival gang member Robert Trevino.
Trevino lived in Oriental Troop turf, and was outside playing football at the time of the assault. Witnesses saw the gang members approaching and warned Trevino to go inside. According to a County of tulare District Attorney’s office press release, Trevino refused, saying he was not doing anything wrong.
One of the gang members distracted Trevino by shaking his hand, when, at the same time and from a distance of less than three feet, Chawa See reportedly shot Trevino in the side of he head with a .380 semi-automatic handgun. Trevino died almost immediately.
The gang members fled the scene, but Chawa See, Lavang See and Aitang See were arrested within several weeks and charged as adults.
In December 2007, all three planned and made an escape from custody after being transported to the Visalia Courthouse for a hearing — only to be recaptured the same day.
At the May 20 sentencing, Hollman sentenced Chawa See and Lavang See to life without the possibility of parole, plus an additional and consecutive 25 years to life.
Hollman sentenced Aitang See to 50 years to life. He received a lesser sentence because he was only 15 years old at the time of the killing. He was therefore ineligible for a life sentence without the possibility of parole.

Black Mafia gang member sentenced to life for murder

The alleged shot-caller of the Oxnard-based Black Mafia criminal street gang was sentenced today to life in prison without the possibility of parole.
Last month, it took a jury less than three hours to find John "Rocky" Lewis guilty of first-degree murder for his role in the 2006 death of 29-year-old Fred Williams of Oxnard.
Lewis, 33, a former Oxnard resident, was convicted of hiring fellow gang member Bakari Pitts to kill Williams, who also was a Black Mafia member.
Pitts testified that Lewis paid him $5,000 and some marijuana for killing Williams. He was shot execution-style in the Somis area on May 12, 2006.
Before being sentenced today, Lewis, who was dressed in blue and orange jail garb, addressed the court. He expressed his "condolences" to the victim's family members who were in the courtroom.
He told the judge that he was innocent and accused the district attorney of "bamboozling" the jury to get him convicted.
"They know I had nothing to do with this," Lewis told the court. He said he isn't an "angel" but also isn't the "devil" as prosecutors tried to portray him during his trial, he said.
Ventura County Superior Court Judge James Cloninger told Lewis that there was a "great deal of credible evidence" given to jurors to convict him.
"They didn't do this because they were bamboozled," the judge said. "You were fairly tried and fairly convicted, sir."
The judge denied a motion by Lewis' lawyer, Steven Powell, for a new trial and ordered Lewis to pay more than $10,000 as restitution.
Powell said in an interview that the verdicts will be appealed. The jury found true all of the special circumstances and allegations against Lewis — that he was a principal participant in an offense committed with a firearm, that the murder was for financial gain, and that it was done to benefit a street gang, the Black Mafia.
Williams' family members who were in the courtroom but made no victim-impact statements.
Outside the courtroom, Williams' mother, Jo Helen Williams, said: "This guy had my son cold-bloodedly murdered for no good reasons. Today is one of the best days I've had since this happened two years ago."
She expressed gratitude to prosecutor Cheryl Temple along with the detectives from the Ventura County Sheriff's Department.
Williams dismissed Lewis' courtroom comments, saying she didn't give them any weight.
Lewis testified during his trial and denied any involvement in Williams' shooting.
During the sentencing today, Temple said Lewis acted in a "cowardly" way and got someone else to pull the trigger.
She said Lewis proved to be "an incredibly untruthful witness" on the stand during his trial.

Deonte "Oink" Donald, 22, was convicted March 27 of four counts of first-degree murder, one count each of kidnapping and making criminal threats and multiple counts of robbery and attempted robbery.
He also was convicted of two special circumstance clauses that resulted
The gang members called themselves the "Nut Cases" because authorities said they engaged in their crime spree mainly for thrills. Some members of the group sported tattoos of the Planters "Mr. Peanut" logo.
Donald's sentencing means that six of the eight Nut Cases defendants charged in 2003 have had their cases resolved. Most of the defendants have been sentenced to life terms.
On Thursday, 30 year-old Aminah "Nay-Nay" Dorsey-Colbert pleaded no contest to second-degree murder for the execution-style slaying of her former lover, 36-year-old Joseph Mabrey, in the 3200 block of Storer Avenue in the Oakland hills on Oct. 24, 2002.
According to prosecutor Michael Nieto, Colbert's husband, Gregory Colbert Jr., ordered the hit after he learned that Mabrey was having an affair with his wife while he was in prison.
The shooting was carried out by another Nut Cases member, DeMarcus Ralls, 24, who's serving a life term for participating in five murders, but Dorsey-Colbert was charged because she helped set up the incident.
Dorsey-Colbert is scheduled to be sentenced on Aug. 22 and is expected to receive a term of 15 years to life in state prison.
Jury selection for the last remaining defendant, Leon "Twan" Wiley, 29, is scheduled to begin Monday. He's charged with three counts of murder.
Prosecutors believe that Gregory Colbert Jr., 28, was the leader of the Nut Cases gang but he wasn't charged with the other defendants in the case and he was charged separately.
On March 23, 2007, Colbert was sentenced to 75 years to life in state prison for murdering another member of the gang, 20-year-old Glen Phason, in June 2004.
In a May 2 interview with a probation officer, Donald said he realizes that he was "a follower" during the Nut Cases crime spree and he doesn't want to associate with fellow gang members while he's in prison

Violence between the Oriental Troop and Norteños, which began in the 1990s over "turf," has spilled over into schools, parks and stores.
As vicious and violent as the Norteños can be, OT members are even more so.
"Oriental Troop are usually armed and will use their guns on the spot if the need arises," Fahoum's report states.
Those weapons include shotguns, rifles and assault weapons.

SAN DIEGO – A 21-year-old man who prosecutors said was on a mission to kill rival gang members was convicted Wednesday of murder and other felonies stemming from a trio of drive-by shootings in 2004.
A San Diego Superior Court jury found Robert Myers, 21, guilty of two counts of first-degree murder, three counts of attempted murder and two counts of shooting into an occupied vehicle.
Because of special-circumstance allegations, including multiple murders, Myers could be sent to prison for life without the possibility of parole. A sentencing hearing is scheduled Sept. 24.
Also charged in connection with the slayings are brothers Dejon Satterwhite, 19, and Edward Eugene Thomas, 21, both of whom are scheduled to go to trial Sept. 29.
All three defendants were minors at the time of the incidents, but were later charged as adults.
Deputy District Attorney Michael Runyon said the men are gang members who were on a “hunting trip” to find and kill rivals. Runyon said the defendants took part in three drive-by shootings the weekend of Aug. 13-14, 2004, which left two people dead and others injured.
Runyon said no witnesses testified they saw Myers shoot a gun during any of the three incidents. However, Runyon said evidence at trial pointed to Myers' guilt, either as a conspirator or an aider and abettor.
According to testimony, the first shooting happened on Aug. 13, 2004, on Gribble Street in the Skyline neighborhood of San Diego. Multiple shots were fired around 11:30 p.m. from a white Ford Expedition at a group of people standing in front of a house. One victim was shot in the ankle.
Witnesses said a hat worn by one of the people in the Expedition flew off during the shooting. DNA tests linked the hat to Myers, prosecutors said.
The next shooting occurred about an hour later after a caravan of cars left the parking lot of a nightclub in Linda Vista. Witnesses said they saw a white Expedition in the parking lot and later saw it following them on southbound state Route 163.
Shots were fired on the freeway as the cars neared Mission Valley. Richard Wilson, 22, of Lemon Grove, was shot in the head and shoulder. A passenger in the BMW that Wilson had been driving was shot in the back but survived.
A third shooting happened the next day about 9:15 p.m., when multiple shots were fired at a group of people at a bus stop on Meadowbrook Drive in Skyline. Lee Smith Jr., 16, a Morse High School junior, was fatally injured.
Witnesses told police the shots were fired from a white Expedition and told the officers where to look for the vehicle. Within minutes, a patrol officer saw the vehicle and followed it to the parking lot of an apartment complex.
One person ran from the Expedition. Three others – including Myers – were arrested when more officers arrived. Two guns and extra bullets were found inside the vehicle, resting at Myers' feet.
The prosecutor said ballistics tests linked the freeway shooting to one of the guns found in the SUV. He said there was no evidence that the murder victims were gang members.

A Rolling 40s gang member convicted with another man of kidnapping a woman from a West Hollywood parking lot, and then robbing her and repeatedly raping her during a daylong ordeal was sentenced Monday to more than 352 years in prison.
Denson Henderson, 28, was sentenced to seven life terms by Beverly Hills Superior Court Judge Elden S. Fox for masterminding the kidnapping and sexual assault, and he won’t be eligible for parole for 352 years and four months.
In October, jurors convicted Henderson and co-defendant Jovanny P. Theus, 27, of multiple counts of sexual assault for the February 2006 kidnapping and rapes. The two members of the Rolling 40s kidnapped the victim from the parking lot of a West Hollywood restaurant, then drove her to several ATMs in a failed attempt to withdraw money. The pair then repeatedly raped the woman at a South Los Angeles home.
Henderson and Theus were connected to the crimes after their arrest in an unrelated assault with a deadly weapon in March 2006. Theus was sentenced in April to five consecutive life terms, with a minimum of 245 years and four months in prison before becoming eligible for parole.

That's the number one problem Mc with a lot of people. They DO NOT and WILL NOT think. Just flat out refuse. People are getting their arse's handed to them in hand baskets in courts all day and everyday. Everyone get's touched sooner or later. Look at the amount of time these young people are getting. Practically every so called hard G has receieved 20 + years or life, sometimes death. Over what? "my hood." Once you go inside and a few months later the hood will forget you. SANTA ANA – A Long Beach gang member was convicted Wednesday of fatally shooting a man sitting in his car at a Santa Ana carwash in an attempted robbery, a prosecutor said.
Narong Thongden, 27, became the third man convicted in the May 10, 2006, slaying of Miguel Davila, 26, who was in the rear vacuuming area of the carwash on 17th Street when he was shot. He died at a hospital, police said.
Thongden faces life in prison without parole when he is sentenced Nov. 7. He was convicted of first-degree murder and two special circumstances of murder for a criminal street gang and during the commission of a felony, said Deputy District Attorney Mark Geller.
Thongden, Richman Em, 18, and Joshua Thomas Richards, 22, were members of Exotic Family City Crips, based in Long Beach, Geller said.
“We'll never know exactly what brought them to the carwash,” Geller said. “They tried to rob the guy and he didn't want to give up the car or his wallet.”
Davila was shot four times, Geller said.
Davila left a key piece of evidence with the statement, Geller said, that “two Asian guys tried to rob me.”
Em was convicted last year of first-degree murder, with a gang enhancement, street terrorism and use of a firearm, and sentenced to 50 years to life in prison.
Richards pleaded guilty to voluntary manslaughter with the enhancement of street gang activity and was sentenced to 16 years in prison.
A woman who was driving the getaway car when it was stopped by a Garden Grove police officer is expected to plea guilty Friday to being an accessory after the fact, Geller said.
Geller said the officer was in the area writing a report when he heard a gunshot, drove to the scene and saw the car drive away from the carwash. The weapon used to shoot Davila was found inside, Geller said.
Associate Public Defender Hector Chaparro argued that Thongden fired at Davila in self-defense, Geller said.
Chaparro claimed that Thongden and Davila were in a sparring match, and that when Thongden stuck his head in the window of the car, Davila tried to stab him.
Geller said a knife was found in the car, but the jury obviously did not believe the self-defense theory, despite the argument that the victim started the confrontation and that Thongden was not trying to rob him.
Davila was in a drug diversion program for possession of a methamphetamine pipe, but did not complete the program, Geller said, adding that he had no other record

Godoy and Ramos had been doing business together and owed drug money to someone in Anaheim, according to the release. Godoy and Gonzales went to Ramos' home that night to try and collect Ramos' portion of the debt. They were armed with a .25 caliber pistol and a knife, respectively.
Ramos, another man and the man's girlfriend were at the apartment during the confrontation. The man was smoking a cigarette on the back patio when Godoy and Gonzales forced him back into the apartment at gunpoint, the release states.
Once inside, Godoy demanded Ramos give him the money for the drug debt, while Gonzales wielded a knife to keep everyone at bay. When Ramos refused to give Godoy the money, Gonzales signaled Godoy, who shot Ramos six times, nearly killing him, the release states.
Witnesses told police they saw five to six men outside the apartment acting as lookouts just before the shooting. They also said they were threatened by the men to not talk to police, the release states.
Two days later, authorities served search warrants at Godoy and Gonzales' apartments and found ammunition and the gun that was used to shoot Ramos. Large amounts of gang paraphernalia and gang graffiti also were found in both homes, according to the release.
Godoy and Gonzales were arrested on suspicion of attempted murder, assault with a deadly weapon, robbery, burglary and false imprisonment.
The charges also carried gang enhancements. Godoy is a validated Sureno and Gonzales is a former member of the Mexican Mafia prison gang, the release states.
While they were in jail, Gonzales and Godoy, as well as other inmates, exchanged jail house letters outlining a plan to hurt and kill witnesses who were going to testify against the two men. The confiscated letters also outlined a fabricated defense that the two men worked on in order to deceive a jury if the case got to trial, the release states.
A jury convicted both men of attempted murder, assault with a deadly weapon and false imprisonment.
Godoy was sentenced to 59 years and four months to life in prison. Gonzales, who had two "strikes" prior to the shooting, was sentenced to 146 years to life under the state's Three Strikes law, the release states.
"Gang cases are difficult to prosecute because of the fear and intimidation that gang members instill in the community and among witnesses of a crime," Deputy District Attorney Deanna Hays stated in a news release.

Valladares is a validated member of this gang, Romanacce said.
Once partygoers found out that Rodarte was from a rival Sureño gang, they yelled, "Get the scrap." Scrap is a derogatory term for a Sureño.
A woman yelled, "Kill him."
Rodarte left the party, but the partygoers chased him onto the 400 block of Independencia Avenue. At one point, Rodarte, who was not armed, was fighting off nearly 10 rivals, some of them with knives, Romanacce said.
Duran was stabbed trying to help his brother.
Romanacce said Valladares stabbed Rodarte in the chest with a kitchen knife. The blow was so fierce it went through a bone and into the victim's heart, he told jurors.
According to Romanacce, Valladares then yelled: "Remember who did it — Reedley Norte. Remember who put him down."

Two Monrovia gang members convicted of attempted murder

PASADENA - A Pasadena jury has convicted two local gang members of attempted murder for their roles in a 2007 shooting that wounded a 48-year-old Monrovia woman inside her home.
Rashon McDaniels, 30, and Melvin Mapps, 27, both of Duarte were convicted of attempted murder for shooting a woman after she answered a knock at her door late in the evening of Feb. 9, 2007.
The two men are members of the Duroc Crips, a local gang, according to Monrovia city spokesman Dick Singer.
A third Duroc member, 30-year-old Mario Alford, pleaded guilty to attempted murder charges and will receive a 23-year sentence.
McDaniels and Mapps each face maximum sentences of 34 years to life in prison, according to Singer.
The victim, who was not gang affiliated, was shot in the shoulder and chin when she answered her door, according to Singer. She then fell to the floor and was shot again in the upper left thigh.
"They had gone up to the door and when the woman answered the door, they shot her through a security screen," Monrovia police Capt. Jim Hunt said.
Hunt said rival gang members lived at the woman's home and were the likely targets of the shooters. The case had been a cold case before investigators got a break, he said.
"We had run out of leads, but the gang task force kept working," Hunt said. "Obviously we're very excited that they got convictions on all these guys."
The jury returned the verdict Friday.

California gang member sentenced to life without parole in massive RICO case

LOS ANGELES (BNO NEWS) – A fifth gang member on Wednesday was sentenced to life without parole after convictions in a massive federal racketeering case, prosecutors said on Thursday.
A fifth member of the Florencia 13 (F13), a street gang involved in narcotics distribution and shootings of African-Americans, has been sentenced to life in federal prison for his conviction on a host of federal criminal charges, including racketeering and narcotics distribution.
Francsico Flores, 24, was sentenced in federal court in Santa Ana, California. Flores received a life sentence, plus a consecutive 10-year prison term. There is no parole in the federal prison system.
Flores was one of ten gangsters linked to F13 who were found guilty just over a year ago of various federal charges, including violating the federal Racketeer Influence and Corrupt Organizations (RICO) act. Flores was specifically convicted of violating RICO by conspiring to commit murder and participating in an attempted murder, participating in a RICO conspiracy, violent crime in aid of racketeering, conspiracy to traffic in narcotics, and use of a firearm.
The ten defendants were convicted at a trial last year, and were among at least two dozen people charged in one indictment that alleged violations of RICO.
F13 operated a number of “drug spots” in the South Los Angeles area. The jury heard testimony that F13 members indiscriminately targeted African-Americans who were seen in their neighborhoods.
During Cruz’s sentencing last Friday, the Judge commented on the criminal activities associated with F13: “I think this particular criminal organization is as ruthless as any the Court had seen. I’ve dealt with the Mexican Mafia, the Aryan Brotherhood now, soon to be the Mongols, but you really take first place. The racism displayed in these tapes, the hunting down and tracking of black citizens, whether they are rival gang members in territory selling drugs, or just the innocent young lady I saw [a robbery victim who was targeted because of her race] that came into this court is barbaric, and I think society needs to draw a rather strong line.”
The investigation into F13, which was called Operation Joker’s Wild, led to what was at the time the largest gang takedown in American history, with 97 of the 104 defendants being taken into custody.

SANTA ANA - An indicted gang member was sentenced today to life in prison without the possibility of parole for murdering one man and shooting two others at a backyard house party in 2000. Edward Ayache, 27, was found guilty by a jury Nov. 4, 2009, of one felony count of special circumstances murder for the benefit of a criminal street gang, two felony counts of attempted murder, one felony count of street terrorism, and sentencing enhancements for criminal street gang activity and the vicarious discharge of a firearm causing death as a gang member.
Defendants
Five additional co-defendant gang members face the same charges as Ayache. Ayache and Steve Morales, 26, Orange, were indicted on Jan. 29, 2009. Ayache was in custody at the time of his indictment after being arrested in Cypress on Jan. 9, 2009, for an unrelated case of one felony count of possession of a firearm by a felon, an additional felony count of street terrorism, and one misdemeanor count of resisting and obstructing an officer. Morales was arrested Feb. 5, 2009, and is scheduled for a pre-trial trial setting conference on Feb. 26. 2010, in Department C-40, Central Justice Center, Santa Ana.
Four additional co-defendants were indicted on May 29, 2009. Johnny Losoya, 31, was indicted as a fugitive and was brought back to Orange County in July 2009 after being arrested in Roswell, NM, for domestic disturbance on June 19, 2009. Daran Gudehus, 35, Soquel, Santa Cruz County, was arrested March 5, 2009. Daniel Cervantes, 25, Buena Park, was arrested March 17, 2009. Gilbert Montijo, 28, formerly of Anaheim, was in custody on an unrelated case at the time of the indictment and was transported to Orange County from state prison. Losoya faces a pre-trial hearing March 12, 2010, in Department C-40. Cervantes, Gudehus, and Montijo are scheduled to face jury trial March 8, 2010, in Department C-40.
Circumstances of the Case
The jury heard the following facts before rendering the guilty verdict against Ayache: At approximately 11:00 pm. on Nov. 18, 2000, the defendants went to a backyard birthday party at a house located at 8127 Stanford Avenue in Garden Grove. The defendants were not closely associated with anyone at the party. Shortly after arriving, the defendants started a verbal argument with several people affiliated with other gangs at the party after yelling out the name of their Anaheim criminal street gang and displaying gang hand signs.
The argument escalated into a physical fight and the defendants shot and murdered victim Michael Olvera, 19, at close range after knocking him to the ground. The victim was shot one time in the leg and three times in the back. After shooting Olvera, the defendants fired into the crowded party. Victim Filipe Ochoa, then-20, was shot in the arm. The defendants fled the scene. As victim Manny Estrada, then-21, attempted to chase after them into the front yard, the defendants shot at him, hitting Estrada in the arm.
The Garden Grove Police Department (GGPD) arrived at the scene and put out a County-wide police radio description on the defendants' light colored sport utility vehicle. Olvera, who was unconscious after being shot four times, was transported to a Garden Grove hospital. He never regained consciousness and died three days later. Ochoa and Estrada were transported to the hospital to be treated for their gunshot wounds and later released. Defendant Morales, claiming to be a victim, went to the hospital that night to be treated for a gunshot wound to the hand.
In 2002, investigators from the Orange County District Attorney's Office (OCDA) learned that defendant Morales had been arrested in Buena Park in December 2000, one month after the murder of Olvera, for possession of a firearm and methamphetamine. Defendant Cervantes was also arrested with Morales. Ballistics testing in April 2002 on the gun seized during Morales' December 2000 arrest was linked to the gun used in the murder of Olvera.
In June 2002, all of the current defendants were arrested for the murder, with exception to Gudehus, whose whereabouts were unknown at the time. Due to a lack of corroborative evidence at the time, a criminal case was not filed.
In February 2007, the OCDA and GGPD began re-investigating the case after uncovering new witnesses and evidence identifying the defendants as the shooters at the party.
During the sentencing today, Olvera's father, mother, and brother gave victim impact statements. The victim's mother, Colleen Von Flatow, explained that she will always feel the loss of her son and kisses his photographs and bedroom door every day as she passes them in the hall.
Senior Deputy District Attorney Jim Mendelson of the Gang Unit prosecuted this case.

Howard Astorga, 26, was convicted in February of the killing of Roberto Lopez Jr, who was hit by a stray bullet as he walked with his sister and cousins to a park in the 1200 block of Court Street, prosecutors said.
Astorga had intended to shoot a rival gang member, police said.
The crime sparked community outrage. More than 500 people attended Roberto's funeral, where Cardinal Roger M. Mahony conducted a Mass in Spanish.

Fresno gang member gets life term

A Fresno gang member was sentenced Friday morning to life in prison with a chance at parole after being convicted in two criminal cases -- the shooting death of a teenager and a jail attack on a gang leader.
Relatives of Antonio Garcia, 23, cried as they told Fresno County Superior Court Judge Arlan Harrell that Garcia was a good person who got involved with the wrong crowd.
In March, a jury found Garcia to be a Norteño street gang member who took part in a jailhouse plot to take out one of its leaders in November 2008. Jurors convicted Garcia of aggravated mayhem and assault and participating in an attack to benefit a criminal street gang.
In November, another jury found Garcia guilty of manslaughter for the killing of 16-year-old Steven Keffel in southwest Fresno on Feb. 11, 2007. He also was convicted of attempted manslaughter of one of Keffel's associates and possession of cocaine for sale.
Harrell ordered Garcia to serve four years in prison before beginning the life prison term. That means Garcia will be eligible for parole after serving a total of 19 years, lawyers said.

Gang member convicted in Picnic Day fight case

A conviction of a known gang member has resulted from the injury to a man who had his eye pop out when he sneezed after being sucker punched on Picnic Day.
Steven Hector Martinez, 35, of Woodland was sentenced to 31 years to life on Thursday in Yolo Superior Court.
The Yolo County District Attorney's office said that Martinez hit a man in the eye on April 18, 2009, when the victim tried to break up a fight in downtown Davis.
A University of California, Davis student followed the attacker and directed a Davis police officer by cellphone. Martinez was arrested and identified by the victim as the assailant.
The victim went to the hospital but left before being treated because he said there were two elderly men who looked in worse condition. However, according to the district attorney, "three days later, the victim sneezed and his eye popped out of his socket. He pushed the eye back in and went to the hospital."
X-ray images revealed that the eye socket was shattered in two places and parts of the bones were dislocated and depressed into the victim's head. He suffered extreme pain, according to a district attorney's press release.
Martinez was sentenced under the state's "three strikes law." The the said Martinez is a member of the Sureno gang.

Encinitas gang member sentenced in Solana Beach melee

Barrio Encinitas gang member Jesus Novoa Jr. will spend seven years in prison for his role in a March 7 melee in Solana Beach with the Colonia Eden Gardens gang.
Novoa was the only participant implicated from the brawl that left four seriously injured with stab wounds.
Defense attorney Rena Wallenius said Novoa would serve a stipulated sentence of three years for pleading guilty to assault with a deadly weapon and an additional four for committing a crime for the benefit of a street gang. Wallenius said prosecution and defense settled the case in court after a preliminary hearing.
She said the sentence does not mean Novoa admitted to actually stabbing a rival in the melee.
"When a person is charged, as he was, he can be liable under the law for the actions of his comrades, so to speak," she said. "If a group of 15 showed up and four people ended up being stabbed, probably by four different people, we don't know for sure but let's make that assumption, then all 15 of those assailants can be held liable under the law for the assault because they aided and abetted in the commission."
A call to prosecutor Geoff Allard was not returned.
Novoa, who pleaded guilty on June 24, will be formally sentenced at 1:30 p.m. July 22 in Vista, department five.
Encinitas Sheriff's Detective Lauren McAllister said no other arrests have been made, but that the investigation is ongoing.
