Canadian denies guilt in beating of officer

LOCKPORT - A Niagara Falls, Ont., man pleaded not guilty Thursday in Niagara County Court to beating a Niagara Falls police officer with a baton Aug. 27.
John A. Guitar, 43, was charged with causing physical injury to Officer Jon Schuster while Schuster was attempting to make an arrest.

Guitar is free on $5,000 bail, charged with two felony counts of second-degree assault, fourth-degree criminal possession of a weapon and resisting arrest.

Nurse finds man raping sedated female patient

NIAGARA FALLS - A nurse making routine checks Saturday afternoon in Niagara Falls Memorial Medical Center found a sedated female patient being raped by a former boyfriend in her hospital bed, police said.
The victim, a 17-year-old city girl, was admitted Friday with severe abdominal pains after giving birth to her second child New Year's Eve. The 28-year-old former boyfriend is the father of both children, police said.

At about 3:30 p.m. Saturday, a nurse found the door to the woman's room closed and, upon checking, saw a partially naked man atop the sleeping woman. When she yelled at the man, he got up, apologizing, and the patient awoke. She told police she had not known the man was raping her, nor had she given consent.

When the nurse went to get a supervisor, the man fled the hospital. He is being sought by police.

Cops seek suspects in armed robbery

Falls police are looking for three suspects in connection with the robbery of a cab driver Monday afternoon.

A 47-year-old driver for Blue Taxi told officers he was dispatched to a call on the 3200 block of Ninth Street at 12:18 p.m. and pulled into a parking lot there to pick up his fare. He said three men came out of an apartment complex and walked over to his cab.

One of the men got into the front seat of the cab, while the other two got in the back seat. Before the cabbie could pull away, the man in the front seat pulled out a silver, semi-automatic handgun and pushed it into the right side of the driver.

“Give me all your money or I’ll shoot you,” the gun-wielding man said.

The second man reached into the cabbie’s shirt pocket and took some cash. The driver also gave some cash to the front seat suspect.

All three men then jumped out of the cab and ran from the area of the parking lot.

Falls man sitting in car shot in arm; two run off

1/9/2007

NIAGARA FALLS - A South Avenue man told city police someone shot him in the upper arm while he was in a car at 11:30 p.m. Sunday in the 1500 block of Ashland Avenue.
A witness said two men in dark clothing left the area, running north on 17th Street.

Crews from Rural/Metro Medical Services took the victim to Erie County Medical Center in Buffalo, where he was in stable condition Monday.

NIAGARA FALLS: Person shot during undercover investigation

Federal agencies tight-lipped after Thursday night incident

“... basically, it was an undercover operation that went wrong.”

Those were the words of Bob Wilson of the Bureau of Alcohol, Tobacco and Firearms after a Thursday night shooting in or around a largely vacant plaza near Wal-Mart on Porter Road.

Law enforcement officials released very few details of the incident, which occurred about 8:30 p.m. Thursday night.

Wilson said the incident happened during a joint investigation by the ATF and Immigration and Customs Enforcement of a group trafficking guns in the area.

During the course of the investigation, officials met up with four suspects at an undisclosed area near either the shopping plaza or Wal-Mart.

During the meeting or in its aftermath, an “individual” was shot. One Falls police official said the person was shot in the leg, but that couldn’t be confirmed Thursday night.

Wilson would not say whether the person shot was related to the investigation or if it was a bystander.

Falls Superintendent John Chella said late Thursday that the person shot was not a law enforcement official.

“That was my first question,” he said.

Due to the nature of the investigation and the agencies involved, Chella said he could not discuss much of the events except to say that Falls police had been contacted to assist the agencies in the investigation.

Chella said four suspects were in custody and police had recovered a gun at the scene.

During the initial moments of the incident, police were directed to guard a garbage can near Wal-Mart where a gun might have been ditched and a call came over the scanner that a cell phone had been found on the roof of the building.

Officer shot in Falls

An undercover officer was shot and four people were arrested Thursday evening in the parking lot of the Wal-Mart on Porter Road, police said.
The incident was connected to an investigation of gun trafficking by the federal Bureau of Alcohol, Tobacco, Firearms and Explosives and Niagara Falls police, authorities said. The four were accused of buying and selling firearms illegally. Joseph G. Green, a spokesman for the ATF, offered some details of the incident.

He said both departments were conducting an undercover operation, purchasing firearms in the parking lot about 8 p.m.

Officers had already met with the suspects, who were not named, on another occasion, Green said.

On Thursday evening, the suspects "had intended to just rob the undercover operative," the spokesman said. One suspect got into the front seat of the undercover operative's vehicle, while the second got in the back seat, Green said.

The suspect in the front seat grabbed the money while the one in the back fired a gun, hitting the undercover officer in the leg, said Green, adding that the injury did not appear to be life-threatening.

Then, officers moved in and another shot was fired at a police vehicle, Green added. The two suspects surrendered and police recovered two handguns, Green said. Information on the arrest the other two people was unavailable.

A Niagara Falls man was shot and killed early Saturday following an argument that began inside of a Niagara Street bar.

Police were called to the 1900 block of Falls Street at 3:48 a.m. and found 22-year-old Noah L. Willoughby lying on a sidewalk at the side of a residence with a gunshot wound to his chest, Detective Capt. Ernest C. Palmer said.

Willoughby, 535 23rd St., was transported to Niagara Falls Memorial Medical Center where he was pronounced dead a short time later. An autopsy has been scheduled for Monday.

Police are looking for a male suspect who witnesses say was involved in a heated argument with Willoughby earlier in the evening inside of Norm’s Bar, 1951 Niagara St.

“The heated argument resulted in a large fight among patrons and the owner closed the place down early,” Palmer said.

The dispute didn’t end there, however.

“The two men met up later at the home of a mutual friend, and the suspect pulled out a handgun and fired one round into the victim’s chest,” Palmer said.

A rifle also was recovered at the scene of the shooting.

Police spent Saturday interviewing several witnesses and searching for the suspect. No arrest was made as of late afternoon.

While the shooting didn’t occur at Norm’s, the bar has become a hotbed of problems lately, including a large fight inside the business last month that sent a woman to the hospital after she was hit in the face with a pool stick.

“That particular bar has become a focal point for police attention as of late,” said Palmer, adding he thinks the bar’s owner is trying his best to keep order. “He’s just been unable to control the clientele.”

A Falls couple were arrested on multiple charges. Jose Riosbaez, 32, 416 22nd St. was charged with third-degree criminal possession of a weapon, endangering the welfare of a child and possession of a hypodermic instrument. Christine L. John, same address, was charged with endangering the welfare of a child and possession of a hypodermic instrument. Police said they were called to the couple’s apartment for a report of adults using drugs with a child present. When officers arrived, they said they found a hypodermic needle and a shot gun within the reach of a small child.

NIAGARA FALLS: Police nab repeat offenders in drug raids

Two of three people arrested Thursday in a drug raid at 1727 Ashland Ave. had been picked up in a drug raid Nov. 11 on Pierce Avenue, according to police officials.

The raid was one of two performed by Falls police Thursday and Friday in an attempt to address city crack houses. The search warrants were signed by City Court Judge Angelo Morinello. An apartment over the U.S. Post Office at 2020 Pine Ave. was raided Friday night.

Members of the Falls’ emergency response team under the direction of Detectives John Faso and Ted Weed executed the warrant on Ashland Avenue Thursday due to a high level of drug traffic, Narcotics Division Capt. Morris Shamrock said.

As the police made entry into the home, one of its occupants, Tywon N. Mallory, 18, tossed a loaded pistol from a second-story window.

“He told us he threw the gun out the window because he had other felony charges pending,” Shamrock said.

In fact, Mallory was arrested Nov. 11 after Falls police stormed a highly fortified drug house on Pierce Avenue and found three loaded guns and crack. Also picked up that night — and Thursday night — was Courtney T. Moragne, 25, 1846 Linwood Ave.

Moragne, Shamrock said, was also arrested with guns and drugs on June 11 on 16th Street.

Mallory was charged with third-degree criminal possession of a weapon, fourth-degree criminal possession of stolen property (the gun he threw out the window was reported stolen out of Depew, Shamrock said) and seventh-degree criminal possession of a controlled substance.

Moragne was charged with seventh-degree criminal possession of a controlled substance.

In addition, Tamika N. Florence, 19, 1727 Ashland Ave., was charged with seventh-degree criminal possession of a controlled substance and three counts of endangering the welfare of a child. Shamrock said three children less than 6 had access to crack on a table in the home.

On Friday, Michael A. Howard, 20, 2020 Pine Ave., Apt. 6, was charged with criminal possession with intent to sell and criminal possession of a drug, both felonies. Detective Bryan Dalporto reported a 1/2 ounce of crack was found in Howard’s apartment.

Shamrock said Howard was dealing crack from the second floor of the post office.

“It was a high volume location. We’ve been watching it for a while,” Shamrock said. “It was a 24/7 operation.”

Motel robbery described as drug deal gone bad

NIAGARA FALLS - A man and woman were robbed at gunpoint Thursday night in a Niagara Falls Boulevard motel room in what police described as a drug deal gone wrong.
A 28-year-old Welch Avenue man told police he called an acquaintance and asked him to bring marijuana to his room in the motel on the 6600 block of Niagara Falls Boulevard.

He told police that the acquaintance arrived just before 6 p.m., followed a short time later by an unknown man armed with a shotgun, who charged into the room and demanded money. The victim said he and his 21-year-old companion were forced to get on the floor before he turned over $750 and she gave up $450.

A cell phone belonging to the intruder was found at the scene, police said.

STABBING: Police were called to Niagara Falls Memorial Medical Center about 5:30 p.m. Saturday for a man who had been stabbed in the cheek. Officers said the 23-year-old Spruce Avenue man was uncooperative and told him he had been attacked by an unknown person on the 1800 block of Elmwood Avenue. His wound required four stitches.

Shot hits home of ex-labor leader's father

Others strike vehicles outside Falls residence after Ch. 4 promotes series on Laborers Local 91

NIAGARA FALLS - Gunshots were fired into the home and vehicles of the father of former Laborers Local 91 President Mark S. Congi, just hours after a local television station promoted a two-part series about past union-related violence.
Charles D. Congi Sr. will be featured prominently in the stories, scheduled to air today and Friday on Channel 4.

His son was convicted last year on racketeering conspiracy charges and sentenced in December to 15 years in federal prison, the longest term handed down to more than a dozen former Local 91 members indicted on federal criminal counts.

Late Tuesday and early Wednesday - a few hours after a promotional piece aired about the series and featured footage of the elder Congi - shots rang out on 59th Street.

The first hit Congi's house; the others struck his two vehicles.

"Who knows who did this, but it's awful funny that this segment came on about the interviews and then that same night this [shooting] happens," Charles Congi said Wednesday afternoon.

Niagara Falls police said they have no suspects in the shooting but had interviewed family members and done forensic work on the vehicles.

Police Superintendent John R. Chella said his department contacted the FBI and the U.S. attorney's office in Buffalo.

The elder Congi said he was watching television news at about 11:30 p.m. Tuesday when he heard the first shot - a zinging sound, probably the bullet ricocheting off the siding.

The bullet hit the front of the house, near Congi's bedroom, and lodged in the wall.

At about 3:45 a.m. Wednesday, two more shots were fired. One damaged the front windshield of Congi's pickup truck; the other, the side of his car.

Congi said no one was injured but added that his 41/2-year-old granddaughter and his son Charles Jr., who also live in the house, were home at the time of both shootings.

Rob Connolly, the current business manager for Local 91, said the union doesn't condone what happened and has no reason to be involved with an attack on Congi's home.

"We have close to 700 members [current and retired], and they just want to work," Connolly said. "We don't care about the past. We are the future. To attack [Congi] would be a stupid thing to do.

"I think someone is trying to put the heat on us. We brought this union out of the darkness and are succeeding, but people with a loyalty to the past are trying to give us a black eye. When's it going to end?"

For four years, past strong-arm tactics of Local 91 have been on display in U.S. District Court in Buffalo and in the media.

Eighteen members have been prosecuted on labor racketeering counts, and 17 have been sentenced so far.

"I don't know why they would come after me," said Charles Congi Sr., a former member of Local 91. "I even defended the union" - as well as Michael "Butch" Quarcini, the union business manager at the time of the federal crackdown - in interviews with Channel 4, he said.

Quarcini was charged but died in 2003 before he could go on trial.

FBI agents and federal prosecutors called him one of the most powerful figures in Niagara County.

"Butch helped people," the elder Congi said. "He got them hospitalization, dental, sub pay. They never had that before Butch. But this union controlled the building industry, and that was true. Certain people went too far, and they became bad, really bad, throwing bombs in people's houses. And they didn't catch half the people."

Mark Congi received one of the toughest sentences for leading what Assistant U.S. Attorney William J. Hochul Jr. called a vicious group of union henchmen responsible for death threats, beatings, large scale vandalism and a firebombing.

In accepting his sentence, Congi admitted 17 incidents of violence and extortion.

The elder Congi sought leniency and continues to support his son, calling him a "fall guy" who was "just following orders."

He said he hasn't spoken to his son since 1983. Charles Congi Sr. said he was disabled with cyanide poisoning that year at a work site and filed a lawsuit against the union for back pay. He said his son was forbidden to speak to him after that.

"Butch told my son, and any other member of the union, that if they talked to me, they'd be out of the union," the elder Congi said. "You did what Butch told you or you were out. Mark's kind of hard-headed. Maybe he should have talked to me."

Charles Congi, who was on the prosecution's witness list but never called to testify, said in a letter to District Judge Richard J. Arcara that he, too, "did Quarcini's dirty work" from 1960 to 1983.

"I was told by Butch to burn cars, burn construction equipment and shoot holes in water pipes to make non-union contractors sign a union contract with Local 91," Congi said in the letter, which he said he wrote to defend his son and explain the complete control Quarcini exercised over members.

The letter, he added, never was intended to be made public.

A neighbor across the street from the Congi house said he never suspected a shooting in the quiet area of one- and two-story homes and had attributed the noise to firecrackers.

ROBBERY: Police are looking for a suspect in a robbery in the area of Main Street and Cleveland Avenue. A 46-year-old man told officers he was walking in that area at 12:08 a.m. Monday, when he was approached by a suspect who pointed a gun at him and demanded his wallet. The victim said the suspect took $99 out of his pant’s pocket and then ran north on Main Street and east on Ontario Avenue, before disappearing from sight.
