City Attorney Delgadillo Secures Permanent Injunction Against KAM Criminal Street Gang

LOS ANGELES - Los Angeles City Attorney Rocky Delgadillo announced that Superior Court Judge Richard C. Hubbell granted a permanent injunction against the KAM criminal street gang imposing strict conditions on the activities of the gang and its members. The permanent gang injunction bans the KAM criminal street gang and its members, including sixteen gang members identified in the lawsuit, from among other things, associating in public. .The KAM gang has plagued the neighborhoods in Boyle Heights for too long,. said City Attorney Rocky Delgadillo. .With this permanent injunction, we empower this neighborhood and its residents with another tool in breaking the long cycle of gangs and violence..

The Office of the City Attorney filed the underlying lawsuit against KAM on October 3, 2002, and obtained a preliminary injunction against the gang October 25, 2002. KAM started as a tagging crew in the late 1980s and evolved into a turf-based criminal street gang, heavily involved in the illegal sale of rock cocaine. The "Safety Zone" covered by the injunction is about 0.60 square-miles in size, located in the City of Los Angeles, and is bounded by Cesar E. Chavez Avenue to the south, Soto Street to the west, Marengo Street to the north, and the Los Angeles City limits to the east.

The lawsuit alleges that KAM is an unincorporated association and that the conduct and activities of the gang and its members constitute a public nuisance. Filed with the lawsuit to substantiate the allegations against the gang were over 80 declarations documenting over 168 incidents, 35 records of criminal convictions, including 12 convictions for predicate felonies which qualify KAM as a criminal street gang, and 64 photographs. Deputy City Attorney Jim McDougal of Delgadillo's Gang Unit handled the case, with the assistance of officers and detectives from LAPD Hollenbeck Community Police Station, under the direction of Commanding Officer Captain Paul Pesqueira.

This permanent injunction bans members of the KAM criminal street gang from doing any of the following activities within the Safety Zone described above: Do Not Associate: Standing, sitting, walking, driving, gathering or appearing, anywhere in public view or anyplace accessible to the public, with any known member of KAM including but not limited to those members identified in the injunction, but not including: (1) when all individuals are inside a school attending class or on school business, and (2) when all individuals are inside a church; provided however that this prohibition against associating shall apply to all claims of travel to or from any of those locations; No Intimidation: Confronting, intimidating, annoying, harassing, threatening, challenging, provoking, assaulting or battering any person known to be a witness to any activity of KAM, known to be a victim of any activity of KAM, or known to be a person who has complained about any activity of KAM; No Guns or Dangerous Weapons: Anywhere in public view or anyplace accessible to the public, (1) possessing any gun, ammunition, or illegal weapon as defined in Penal Code Section 12020, (2) knowingly remaining in the presence of anyone who is in possession of such gun, ammunition or dangerous weapon, or (3) knowingly remaining in the presence of such gun, ammunition or dangerous weapon;

Stay Away From Drugs: Without a prescription, (1) selling, possessing, or using any controlled substance or related paraphernalia, including but not limited to, rolling papers and pipes used for illegal drug use, (2) knowingly remaining in the presence of anyone selling, possessing, or using any controlled substance or such related paraphernalia, or (3) knowingly remaining in the presence of any controlled substance or such related paraphernalia; Stay Away From Alcohol: Anywhere in public view or anyplace accessible to the public, (1) possessing an open container of an alcoholic beverage, (2) knowingly remaining in the presence of anyone possessing an open container of an alcoholic beverage, or (3) knowingly remaining in the presence of an open container of an alcoholic beverage; No Trespassing: Being present on or in any property not open to the general public, except (1) with the prior written consent of the owner, owner's agent, or the person in lawful possession of the property, or (2) in the presence of and with the voluntary consent of the owner, owner's agent, or the person in lawful possession of the property; and Obey Curfew: Being outside between the hours of 10:00 p.m. on any day and sunrise of the following day, unless (1) going to or from a legitimate meeting or entertainment activity, (2) actively engaged in a legitimate business, trade, profession or occupation which requires such presence, or (3) involved in a legitimate emergency situation that requires immediate attention.

The Los Angeles City Attorney.s Gang Unit has obtained final judgments granting permanent gang injunctions against 18th Street, Canoga Park Alabama, KAM and Pacoima Project Boys criminal street gangs since Delgadillo became City Attorney in July, 2001.
