Hempstead man sentenced to 100 years in Westbury murder

A Hempstead man who shot four men in a car outside a Westbury nightclub, killing one of them, was sentenced Wednesday to spend a century in prison.

Dwayne Dailey, 23, who prosecutors said mistook his victims in the 2008 shooting for rival gang members, was sentenced to 100 years to life in prison by Nassau County Court Judge David Sullivan.

A jury in June took less than two hours to convict Dailey of second-degree murder for shooting into a Honda Civic in February 2008.

“This cold-blooded execution demanded the maximum prison sentence, and I am glad to know that this man will never again see the light of day,” District Attorney Kathleen Rice said in a statement released after the verdict in Mineola.

Dailey’s attorney, Arshad Majid of Hauppauge, said he would appeal. “We’re disappointed,” he said.

Edwin Mejia Alvarado, 17, of Westbury, and three other men were shot by Dailey and a second man, Olban Gonzales, 20, after they left a party at the La Boom nightclub in Westbury, prosecutors said. Alvarado died, and the others were left disabled, prosecutors said.

Gonzales is awaiting trial for murder.

The shooting occurred after a party attended by members of the 18th Street and Salvadorans with Pride street gangs, prosecutors said. Some members of the MS-13 street gang arrived, followed by a group of people – including Dailey, who has been affiliated with the Bloods and 18th Street gangs – with vendettas against MS-13, prosecutors said.

Alvarado and the other victims were not gang members, prosecutors said.

During the six-week trial, Dailey’s girlfriend testified that he admitted committing murder.
