LB TRG plead not guilty in 2019 Halloween shooting

Date of Article: September 29, 2020.

"Tuesday morning marked the first step in what’s sure to be a high-profile, complicated legal battle for the eight men accused of killing three people and wounding nine more at a backyard birthday party in October—a crime police have called one of Long Beach’s worst mass shootings in recent memory. Spread out along a hallway inside the Gov. George Deukmejian Courthouse this morning, at least half a dozen defense attorneys assigned to the case talked with family members and friends of the accused, telling them they were still sorting through reams of evidence prosecutors recently turned over to them, a legal requirement called “discovery.”

Over the next hour, seven of the eight defendants were led one-by-one into the courtroom. Handcuffed and wearing masks to limit the spread of coronavirus, they all took turns pleading not guilty to the charges they’re facing: three counts of murder and nine counts of attempted murder. The final defendant was expected to plead not guilty in the afternoon, according to his attorney, Edward Murphy. During the hearing, each of the accused killers answered a few procedural questions and agreed to a schedule for the next court date before they were ushered away again. Only one man’s lawyer went beyond simply entering the plea and setting dates.

Eric Renslo, who represents 25-year-old Jeremy Penh, asked Judge Tomson T. Ong to lower Penh’s bail. Based on the discovery revealed so far, Renslo said, he’s seen no evidence Penh was one of the shooters. It’s unclear if police believe Penh fired a gun during the attack. They’ve said eight suspects drove to the party as part of the planned operation, but only three of them actually pulled the trigger once they reached their target. “There’s been no discovery with my client’s name on it,” Renslo said, arguing that Penh should have a chance to be released while awaiting trial. Ong denied the request after prosecutor Cyndi Barnes pointed out that the charges against Penh automatically carry a no-bail status, regardless of what Renslo thinks the evidence shows.

Penh and his co-defendants—David Heng Long, Kaylin Thik, Ryan Sim, Jeremy Penh, Christopher Williams, Danny Sourn, Joshua Sam and Grant Johnson—could all face the death penalty if they’re convicted. Often, complicated death penalty cases can take years to reach trial. Police allege the men in this case were targeting rival gang members when they opened fire on a Halloween-themed backyard party in Long Beach’s Rose Park neighborhood on Oct. 29. According to two law enforcement officials familiar with the case, the men are accused of being members of the Tiny Rascal Gang and they targeted the party believing members of the Asian Boyz were among the crowd.

However, there were no gang members at the party, according to Long Beach Police Chief Robert Luna. The gathering was a party attended by a group of coworkers, victims told the Post. The victims were 25-year-old Maurice Poe Jr., a Long Beach father with a 3-year-old daughter; Melvin Williams II, a 35-year-old from Gardena who sang choir in Los Angeles; and 28-year-old Ricardo Torres, one of the many co-workers attending the party, according to a colleague, who described Torres as a “good man, always smiling.” Authorities announced the charges against the eight accused killers on Sept. 8 after sweeping raids that stretched from San Jose to Fresno, Redlands and Long Beach.

Four other people were arrested in that operation, but they were booked on suspicion of weapons or accessory charges, not for the killings themselves."
