Isaac Pedroza talks about getting his murder conviction overturned.

Isaac Pedroza was convicted of murder allegedly ordered by Mexican Mafia member, Eulalio “Lalo” Martinez, of Donald “Pato” Schubert from his prison cell at Pelican Bay back in 1998. Ten years later, while visiting is parole officer, Pedroza was arrested, went to trial and was convicted of first degree murder. On his way to serve a life sentence, his attorney Alex Kessel was able to get Judge Cathleen Kennedy to order a re-trial.

Before the second trial, Pedroza’s attorney made another argument citing Louisiana v. Hudson that stated without any new evidence Pedroza is being subjected to second jeopardy.  That case law prohibited the use of the evidence that convicted Pedroza the first time. Judge Kennedy had to dismiss Pedroza’s case and after sitting in the Los Angeles County jail for 5-years he was free.
