Why the Jury voted for an Acquittal in the Shooting Death of Rapper Dolla

LOS ANGELES, Calif. – On May 21, 2010, Aubrey Berry, the man charged in the shooting death of rapper Roderick “Dolla” Berry was acquitted of all charges. Last year the two had an encounter at the valet area of the Beverly Center when Berry drew his weapon and killed Burton.
He was charged with first degree murder, but as the trial progressed, the evidence was revealing that Berry, who was a college graduate and never in trouble with the law, was defending himself from a potential conflict with included Burton and two of his friends.
After the trial, many people lashed out against the jury because Berry was now a free man, but very few people have evaluated the evidence. Unfortunately, after the verdicts were read, the jury did not grant any interviews, so we were not able to find out what evidence was most persuasive. Below are some of the main evidence points that the jury may have been influence by in their acquittal.
Self defense is when someone has an honest belief in the need to defend; and (2) a reasonable belief in the need to defend. The defendant must subjectively or actually believe in the need to defend against imminent harm that will cause death or injury.
1. Eleven day previous, Berry was assaulted in an Atlanta club after talking to Dolla’s girlfriend, Crystal Jackson. Berry and Jackson had first met each other at Clark Atlanta University, but Dolla apparently thought that Berry had disrespected him by approaching her. Berry testified that Damian “Te-Money” Jackson had approached him and then struck him. Berry went down and was subsequently beat by additional person including Dolla and William “Scrap” Robinson.
2. The jury heard evidence that the people who beat Berry were members of the Mansfield Crips. Detective Holguin testified that Te-Money was a documented member of the Mansfield Crips and retired LAPD officer Steve Strong testified that Dolla was a Mansfield Crip. Dolla had a tattoo of “Mansfield Gangsta” on his hand. The jury now had information that this beating was connected to a Los Angeles based Crip gang.
3. Video #1 showed Dolla talking about assaulting a person known as Two Pistols, where in the video he states he confronts “Two Pistols” and asks him, “What’s happening?” the same phrase that Dolla says to Berry when he confronts him at the valet area. Dolla claims that he assaulted him and knocked him out. Dolla’s friend Sadiq “DJ Shabazz” Abawi testified that Dolla did say, “What’s happening?” There was some question if he said “What’s happening Cuzz,” but Abawi denied that he said “cuzz” and that he was not aware if “cuzz” had any gang connotation. Under cross examination Sylvers stated that she did recall Dolla saying, “What’s happening” after she was giving a transcript of her testimony from the preliminary hearing.
4. Abawi testified that Berry did seem scared, then quickly changed it to “not scared but a little shook” and this is the first time the jury realized that the situation could have been intimidating to Berry.
5. Surveillance video inside P.F. Chang’s restaurant showed that William “Scrap” Robinson had been carrying a backpack, but at the time they leave the restaurant, he gives his back pack to Syria Sylvers to hold. The defense suggested that Robinson wanted his hands free because they knew they were going to physically confront Berry.
6. Video #2 is a spontaneous unscripted interview of T.I. talking with Dolla and Te-Money present. The video makes reference to gang, which is what the jury wanted to establish.
7. The defense was able to play one of Dolla’s songs which was used to demonstrate Berry’s state of mind. It was not used for truth or to make any judgments about Dolla, but to present if Berry had a reasonable belief that Dolla could harm him. The song was entitled “Is You Holding” where Dolla talks about carrying a concealed weapon and being strapped. Dolla was arrested 6 months prior for carry a concealed weapon in Georgia, but the judge would not allow that evidence into the trial because the judge did not believe that the arrest alone was indicative that Dolla was violent, but the defense wanted to introduce that arrest because of the similarities it had with the song but the jury never knew about that carry concealed weapon arrest.
8. According to the toxicology report, Dolla was under the influence of Tetrahydrocannabinol (THC) of had 11 nanograms of (THC), the active drug in marijuana, and 59 nanograms of Carboxy THC, an inactive portion of marijuana. The 11ng represented current use of marijuana use that same day. When Sylvers and Abawi were asked about marijuana use that day, they both denied that they or Dolla smoked weed. They testified that they were together since May 17 the night before and spent the entire day of May 18th together before going to P.F. Chang’s. But Dr. John J. Treuting testified to the jury that the marijuana in Dolla’s system was from a couple hours before, so the jury received scientific testimony that conflicted with both Abawi and Sylvers.
9. At the P.F. Chang’s restaurant Berry and Dolla both coincidentally cross paths and while Berry was walking to the bathroom at about 2:53 p.m., Dolla recognizes him as the person from the Atlanta club. Sylvers testifies that Dolla and Scrap have a conversation about Berry, but she did not recall the details of what was said.
10. When Berry returns from the bath room he notices Dolla and his friends but the surveillance video show that he keeps walking to his table. At this time, Berry is armed and when he returns to his table at about 2:56 p.m., he tells his business partner that he notices people from Mansfield Crip that were involved in assaulting him in Atlanta 11 days prior. His friend advises him to leave because he does not want to get caught up in any gang conflict, so at about 3:04 p.m. Berry leaves the restaurant and proceeds to the valet area that is over 200 feet from the door.
11. At 3:05 p.m., Dolla and the group decides to leave the restaurant and it appears that they follow Berry out or it just coincidence that they leave right after him. The video surveillance shows that Dolla is looking and staring as if he is looking for someone. The jury saw the surveillance video of all three men looking in an unusual manner, not the normal way people walk out a restaurant according to the defense attorney.
12. The jury heard testimony that Dolla and his group did not pay the bill. According to Abawi, he told the jury that Dolla paid $100.00 for the bill and that he added $20.00 and just left the money on the table not the bill fold. Sylvers stated that Dolla paid the bill but she didn’t remember anything else. The waiter testified that there was no money in the bill fold and that they left with out paying. The actual bill was $87.00, so if Abawi is correct that they left $120.00, that would mean they left a $33.00 tip. The jury most likely believed that they did not pay their bill, and left the table abruptly at that time.
13. When Dolla leaves the restaurant, Berry is already at the valet area waiting behind two other customers. Berry testifies that Dolla is in front walking rapidly towards him with the men behind him and Sylvers even further behind. The jury saw pictures of Sylvers carrying Robinson’s backpack. Dolla ends up right in front of Berry between 7 to 10 feet in front of him with Robinson and Abawi to Berry’s left. Sylvers provided a diagram of the three men’s positions and it appears that Berry was being surrounded.
14. At this point words are exchanged and according to Sylvers and Abawi, Dolla says, “What’s happening?” to Berry. Abawi testified that Berry did not respond, and Sylvers testified that he did respond. According to an LAPD spokesperson, the exchange of words was characterized as an argument, but both Sylvers and Abawi do not provide any details on what was said. Berry testified that Dolla was speaking aggressively, stating that “your in my hood now,” probably referring to West LA that he represented.
15. Berry testified that Dolla made threatening statements to him and when he appeared to be reaching back, Berry stated that he began to shoot Dolla. The first shot hit Dolla in the arm bicep area. According to both the pathologist and the coroner, the arm had to be reaching back at the point when he was shot. The defense suggested that Dolla was reaching for a weapon, even though no other weapon was recovered.
16. Berry continued to shoot a total of eight rounds striking Dolla in the back twice and the buttocks once. According to the defense all these shots occurred when Dolla was in front of Berry near the valet desk. Dolla begins to run to his right after being shot, because there was a wall or partition right behind Dolla. Dolla eventually collapses about 200 feet away.
Did Berry properly defend himself or did he recklessly use a firearm?

Everyone knows Berry defended himself. Take a step back and put yourself in his shoes for a second: you are about to be jumped or worse, you are alone and away from home, you are stuck in a valet, cornered, and cannot get away. Case closed, self defense. Dolla and his crew were not approaching Berry to reconcile and be peaceful; they wanted to confront and hurt Berry. No doubt, it is terrible that Dolla is gone and the way that he lived, and one has to feel for his family and friends and their grief. Remove all the gang affiliation stuff and the fact that Berry did not turn himself in immediately, and this tragedy remains just that, a tragic meeting and an incident of self-defense.
Well like it or not he is not guilty.

This is gonna be long but bear with me and read the other side to this coin:
This report seemed one-sided, a bit inaccurate and definitely incomplete.
Let me explain something to you as a man who knows some of the people in this story, knows what goes on in the streets, prison and who also has a college-level as well as a cultural knowledge.
Dolla had a peaceful spirit. But if there was an issue he was ready to settle it.
Go listen to his interviews again. He explains that Two Pistols threatened him verbally and that he had no beef with the guy until then. He ran into him at an award show coincidentally and got the best of him in a head up fade. (With a name like “two pistols” I guess Dolla was supposed to be “two scared”?) He struck him, didn’t shoot him. And the fact that he may have said what’s crackin means that he was giving fair warning of the fight to come. He used his HANDS like a true worrier.
See, to me and people who represent THE REAL, you get CREDIT FOR A GOOD FIGHT. It’s only human to settle differences with an occasional square off. You lose credit for running to grab a GUN. Because it says that you are full of hate and full of weakness.
Oh, why did Aubrey AB need a gun permit again? Was he a gang affiliate? Was He trying to protect his hustle? You think he planned on using it one day? We know he had it before he ever met Dolla.
How is it that you’re so sure that A.B. didn’t start this conflict? How many times have we seen different record labels from the same city beef or compete? Do you think Dolla and his girl were seperate at the club in ATL? Is it not possible that Mr. AB decided to approach Crystal as a way of flaunting to Dollar (Musical Competition) that he knew his girl from the past? And I strongly doubt that T-Money encouraged a fight. He is a business man and does not approve of pettiness. He kept Dolla out of ish.
So if we try looking at it like AB was the guy who felt lollipopy because he knew Dolla’s girl and had a license to k, I mean carry a gun, then when they see eachother Dolla did want another fade?
Do we live in a day and age where we r so scared of our brother that we’d rather k him than fight? Or is it that Murder has become so common and Aggrandized that its Cool to open fire in a crowd of people to get some Credibility for being strong? Or do we live in a day and age where this type of behavior is acceptable as long as we can prove that the man who was murdered was not perfect? Or is the court system so fed up that they cant convict this man of one single crime even though Dolla was shot as he lay on the ground face down and then AB shot at others that were standing/running much further away?
AB used his license for holding Firearms as a license to k. He shot the man in the back the ass and the head. He never saw a gun come out on this occasion or the one in Atlanta. From what it seems, He could have had Dolla followed or been called to that location and made sure Dolla saw him. Knowing Dolla wouldn’t turn down a fight he could’ve stared him down and coaxed him outside. AB was there with other folks too and I don’t think he was scared of getting jumped again. He was probably angry, and glad he had the illegal gun carefully concealed. Is this AB such an angle that he was incapable of wanting vengeance? Supposedly a smart guy with college ed so lets assume he could’ve easily planned something like this out.
Bottom line, I did time in jail with a guy who had been in a bad shooting. He got shot in the head by someone who ran up on him. He shot back after falling to the ground and ked the other guy. He got 25-Life for that and he was a sixteen year old kid. So what the f do you mean that Aubrey Somehow beat this case because dolla was affiliated with crip? The crips r a whole other chapter in the book of Black history so I won’t digress. But you cannot give a guy like AB the license to k anyone who may be a gangmember or who may have wanted to fight. Why couldnt AB draw the weapon and make everyone back up? Why did he open fire and then keep shooting after Dolla had fallen and everyone else was running? I knew the victim personally and I will say he was one of the best people I have ever known. I must have seen the absolute best of him because the description of him here is absolutely characterized. I wont go into depth regarding his true person because to be honest, with everything that’s been said- people don’t deserve to know. He was a very good person, with a good heart, ambition, a love for religion, life, journey, and success. Whats done is done. No matter what the jury decided, the damage is permanent. Justice isn’t granted on earth. I feel sorry for the jury because they will never understand the mistake they have made.
